Section A

OVERVIEW AND DEFINITIONS

1. EPIC Coverage. The Epic Coverage Refund Policy (" Ballsy Coverage ") is Vail Resorts' refund policy for all Season Passes. All Season Passes are NON-REFUNDABLE except equally set along in these Terms. Ballsy Coverage applies but to Flavour Passes. It does not apply to whatever other lift access products.

2. Definitions. The following definitions use to these Terms.

"Core Season" ways the menstruum of December 7, 2021 through April 17, 2022, which shall exist deemed to consist of one hundred 30-2 (132) days.

"Credit Rollover" means a Reservation Availability Credit Rollover, C&C Credit Rollover, or Personal Upshot Credit Rollover, equally defined in the 2020/2021 Ballsy Coverage Refund Policy Terms and Conditions.

"Fixed Season Laissez passer" means a season laissez passer that gives the holder a fixed number of days to utilize the laissez passer throughout the season, commonly ranging from one (1) to ten (10) days. A list of Fixed Flavour Passes can be found here.

"General Flavour Laissez passer" means a season pass that is non limited to a fixed number of days during the season, such every bit an Epic Laissez passer or Ballsy Local Laissez passer. A list of Full general Flavour Passes tin exist establish hither.

"Season Laissez passer" or "Pass" ways a Stock-still Season Pass or a General Season Pass.

"Vail Resorts" ways the Vail Corporation, doing business as Vail Resorts Management Visitor, including whatsoever of its subsidiaries and affiliates.

"Vail Resorts Parties" means Vail Resorts and each of its resorts, subsidiaries, affiliates, and their respective officers, directors, employees, contractors, representatives and agents, together with each Partner Resort and their operators, subsidiaries, or affiliates and each of their respective officers, directors, employees, contractors, representatives and agents.

Section B

GENERAL LIMITATIONS ON REFUND ELIGIBILITY

1. Epic Coverage Only. Your Season Laissez passer is Not-REFUNDABLE unless it qualifies for a full or partial refund under these Terms because of a Priority Day Cancellation Event, an Extended Resort Closure Result, or a Qualifying Personal Event (each as defined below, together the "Qualifying Events"). You lot will not be eligible for a refund for any other reason, including but not limited to the post-obit:

a. Weather and Wind. You lot will non be eligible for a refund based on any disability to employ your Pass due to conditions-related or air current-related events, including snow levels.

b. Transportation Issues. You will not exist eligible for a refund based on any inability to use your Pass due to any road closures, traffic issues, parking constraints at or most the resort, flight cancellations, or transportation issues.

c. Vaccine Requirements. You volition not be eligible for a refund based on any disability to employ your Pass due to any federal, provincial, country, or local vaccine requirement, or any vaccine passport or other proof or testament of vaccination required by any governmental or private entity.

d. Psychological Weather. Except as fix forth in Section Due east, you lot volition non be eligible for a refund based on any disability to utilise your Pass due to any mental wellness, nervous, or psychological conditions.

due east. Reservations. Except as prepare forth in Section F, you will not be eligible for a refund in the issue that reservations are required to ski or ride at a resort.

f. Guest Experience. You volition not be eligible for a refund based on your guest experience at any resorts, facilities, or amenities, including with respect to parking.

g. Criminal Acts. You will not exist eligible for a refund based on an inability to use your Laissez passer due to any criminal acts you commit.

h. Pass Revocation. You will not be eligible for a refund based on any disability to use your Pass due to your Laissez passer being revoked, confiscated, canceled, and/or de-activated considering Vail Resorts, its Partner Resorts, or the ski area operator determined, in their sole and sectional judgment, that you acted in a manner that could endanger the safety or health of whatever person, violated whatever police or resort or facility policy, engaged in any fraud, misconduct, or malfeasance, created a nuisance, failed to pay any amounts due for your Laissez passer, or for other practiced cause.

2. No Ballsy Coverage for Partner Resorts. Only resorts owned and operated by Vail Resorts are covered by Epic Coverage. Epic Coverage does not provide refunds related to any Partner Resorts or in connectedness with whatever matters concerning Partner Resorts.

iii. No Ballsy Coverage for Australian Resorts. Merely North American resorts are covered past EPIC Coverage. Ballsy Coverage does not provide refunds related to any resorts in Commonwealth of australia or in connection with any matters concerning whatsoever resorts in Australia.

iv. No Days Remaining on Fixed Season Laissez passer. You will not exist eligible for any refunds if you have used all of the days on your Fixed Flavor Laissez passer.

v. Single Refund Eligibility. In the event yous submit multiple timely and valid requests for refunds, Vail Resorts will process the request that provides the highest available refund amount under these Terms and all other requests will be rejected and null and void.

6. Maximum Refund. In no upshot shall any refund exceed the Purchase Price of your Flavour Pass.

Department C

Epic COVERAGE ELECTIONS

1. Choose Core Season or Priority Days.   EPIC Coverage is designed to provide individualized refund protection, and you may elect either the "Core Season" or "Priority Day" option. Your election impacts the amount of refund y'all are eligible to receive under these Terms if a Qualifying Result occurs. If you make a Core Season election, you must also make either a "Primary Resort" or "All Resorts" election nether Epic Coverage.

2. Making your Election. You may make your election under Epic Coverage through the "My Account" section online at epicpass.com or by calling 970.754.0057.

3. Deadline to Make or Change your Ballot. No later than November one, 2021, Vail Resorts will provide instructions via electronic mail regarding how you may make, update, or change your elections.

iv. Default Elections. If you have not made any elections under EPIC Coverage before the applicable deadlines for doing so, your elections will automatically default to the "Core Flavor" and "All Resorts" elections under EPIC Coverage.

SECTION D

C&C REFUNDS

one. Refund Eligibility. Yous may be eligible for a "Closure and Counterfoil Refund" (or "C&C Refund") if a Priority Day Counterfoil Issue or an Extended Resort Closure Upshot occurs.

a. A "Priority Twenty-four hour period Cancellation Result" occurs when Vail Resorts cancels one or more than of your Priority Days due to a Resort Closure Event.

b. A "Resort Closure Event" occurs at a resort when no lifts are operating at that resort due to i or more of the post-obit reasons:

i. The occurrence of a disease, epidemic, or pandemic, including the ongoing COVID-nineteen pandemic;

ii. The occurrence of a flood, hurricane, tornado, earthquake, fire, or volcanic eruption (each a "Natural Disaster");

iii. The occurrence of a terrorist assail; or

iv. The occurrence of a hostile or war-like action.

c. An "Extended Resort Closure Event" occurs if yous elect Core Flavour and one of the following occurs:

i. Y'all elected a Primary Resort and the Primary Resort you selected is closed for seven (7) or more consecutive days during the Core Season due to a Resort Closure Issue.

ii. You purchased an Ballsy Pass, EPIC Local Pass, Epic Military Pass, or EPIC 24-hour interval Pass, elected All Resorts, and all of the following ten resorts are simultaneously airtight for 7 (7) or more than consecutive days during the Cadre Season due to a Resort Closure Event: Vail, Whistler Blackcomb, Breckenridge, Beaver Creek, Crested Butte, Keystone, Park Urban center, Heavenly, NorthStar and Kirkwood.

iii. You purchased a Northeast Value Pass, elected All Resorts, and all of the following five resorts are simultaneously closed for vii (7) or more sequent days during the Core Flavor due to a Resort Closure Consequence: Stowe, Mount Snow, Hunter, Okemo and Mount Sunapee.

four. You purchased any Season Pass other than those identified in Section D.1.c(i)-(iii) above, elected All Resorts, and all of the resorts to which your Pass provides free access for six (6) or more days during the Core Flavor are simultaneously closed for seven (vii) or more consecutive days during the Core Season due to a Resort Closure Issue.

Your eligibility for a refund and the amount of any refund due to an Extended Resort Closure Event is specific to the Extended Resort Closure Consequence applicable to the Pass y'all purchased and elections you made.

2. Refund Amount. If you are eligible for a C&C Refund, the amount of your refund will exist a percentage of your Purchase Price (i.e., the "C&C Refund Percentage"). The use of your Flavor Pass at Partner Resorts or outside of the Core Season, including during early season skiing or riding with Border Cards (or other products with similar offerings), will count towards the number of days you have used your Laissez passer for purposes of determining the corporeality of any refund for which yous may be eligible. If your C&C Refund Percentage as determined past the applicable formula below is zero or a negative number, yous will not receive any refund.

a. Core Flavour Ballot or Default with General Flavour Pass. If yous have a General Season Pass and elected or defaulted into Core Season coverage, your C&C Refund Percentage will exist calculated based on the following formula:

b. Core Season Elections or Default with Fixed Flavor Pass. If you have a Fixed Flavor Laissez passer and elected or defaulted into Core Season coverage, your C&C Refund Percentage will be the lesser of: (i) the percent of days lost in the Core Flavour due to Extended Resort Closure Events, and (ii) one minus the number of days you used your Pass divided by the number of days bachelor on your Pass up to a maximum of seven (7), as reflected in the following formula:

c. All Others. If you lot did not elect or default into Cadre Season coverage, your C&C Refund Percent volition exist calculated based on the post-obit formula:

iii. Credit Rollover. If you used a Credit Rollover towards the purchase of a 2021/2022 Flavor Pass and you are eligible for a C&C Refund, yous may be eligible to apply all or a portion of the Credit Rollover towards the purchase of an equal or greater value pass for the 2022/2023 ski and ride flavour (the "22/23 Credit Rollover"). The corporeality of your 22/23 Credit Rollover volition equal your C&C Refund Percentage multiplied by the amount of your Credit Rollover actually applied to your 2020/2021 Season Pass. If your C&C Refund Percentage was zero or a negative number, you will not be eligible for any 22/23 Credit Rollover. Yous can but redeem your Credit Rollover towards the purchase of a single Season Laissez passer for the 2022/2023 season. Y'all cannot redeem whatsoever portion of your Credit Rollover for cash. If the Season Laissez passer you buy for the 2022/2023 flavor costs less than your 22/23 Credit Rollover, the remaining portion of the 22/23 Credit Rollover volition be forfeited. Your 22/23 Credit Rollover is non-transferrable. You must utilize your 22/23 Credit Rollover on or before September 5, 2022 or it will expire and be forfeited. Vail Resorts may, in its sole discretion, elect to convert any Credit Rollover or 22/23 Credit Rollover to a refund at whatsoever time.

4. C&C Refund Processing. No action is required of you if you are eligible to receive a C&C Refund. Vail Resorts will calculate, process, and notify you of your C&C Refund betwixt May ane, 2022, and May 31, 2022.

5. No Access Later Refund. If you receive any C&C Refund, the Laissez passer for which you received the refund will terminate to be valid and you will no longer exist able to utilise the Pass to admission whatsoever resorts or receive any other ancillary Pass benefits for the balance of the 2021/2022 flavour.

Department Eastward

PERSONAL Upshot REFUNDS

i. Refund Eligibility . You may be eligible for a " Personal Upshot Refund " if yous are prevented from using your Pass during the Core Season due to a " Qualifying Personal Event ." A Qualifying Personal Event is 1 or more of the following:

a. Stay-at Home Gild. You lot are unable to use your Pass during the Core Season considering the municipality, canton, land, province, or country in which your Permanent Residence is located is subject field to a mandatory governmental "stay-at-habitation" or "shelter-in-identify" order lasting thirty (30) or more sequent days, at least seven (7) days of which are during the Core Season.  Your "Permanent Residence" refers to your fixed, permanent and principal habitation for legal and tax purposes.

b. Tourist Visa Rejection. You are unable to utilise your Pass during the Core Flavor due to a tourist visa rejection that prevents your entry into the U.s. or Canada. Vail Resorts may require verifiable proof of visa rejection as a condition of eligibility for a refund under this Qualifying Personal Event.

c. Travel Restrictions - The states. You are unable to use your Pass during the Cadre Season due to a government-imposed prohibition on your entry into the United States that affects all similarly situated travelers for thirty (30) or more consecutive days, at least seven (7) days of which are during the Core Season.

d. Travel Restrictions - Canada. You lot are domiciled in the: (i) State of Washington or outside of the The states or (2) United States and your Laissez passer merely provides you with admission to Whistler Blackcomb, and you are unable to apply your Pass during the Core Season due to a government-imposed prohibition on your entry into Canada or the Province of British Columbia that affects all similarly situated travelers for thirty (30) or more sequent days, at least seven (7) days of which are during the Cadre Season.

east. Job Loss. Y'all are unable to employ your Laissez passer during the Core Flavor because, subsequently you buy your Pass, you or your spouse or domestic partner who lives in the aforementioned Permanent Residence (each a "Domestic Partner") are/is involuntarily terminated or laid off from full-fourth dimension employment by an employer for which you lot or your Domestic Partner had been continuously employed for at least one year immediately preceding the termination or lay off. This provision is not applicable to function-time employees, temporary employees, independent contractors, gig workers, or self-employed persons.

f. Furlough. You are unable to use your Laissez passer during the Core Season because, after you purchase your Pass, you or Domestic Partner who lives in the same Permanent Residence is furloughed for a period of six (6) months or longer from total-time employment past an employer for which you or your Domestic Partner had been continuously employed for at least one year immediately preceding the furlough. This provision is non applicable to part-time employees, temporary employees, independent contractors, gig workers, or self-employed persons.

chiliad. Work Visa Renewals. You are unable to utilise your Pass during the Core Season considering y'all or your Domestic Partner require a work visa to exist employed in the United States or Canada and your work visa is not renewed after yous purchase your Laissez passer. This provision is not applicable to role-fourth dimension employees, temporary employees, independent contractors, gig workers, or self-employed persons.

h. Employment Transfer. Yous are unable to apply your Laissez passer during the Cadre Season considering you lot or your Domestic Partner have an involuntary, employer-initiated transfer afterward you purchase your Laissez passer that: (i) is within the same system for which y'all or your Domestic Partner have been continuously employed for at to the lowest degree i twelvemonth immediately preceding the transfer; and (two) involves your or your Domestic Partner's relocation from your electric current Permanent Residence to a residence that is 100 or more miles farther away from whatsoever resort covered by your Pass. This provision but applies if you live inside 150 miles of a resort for which your Laissez passer provides access.

i. Military Service. You lot are unable to use your Pass during the Core Flavor because afterwards you purchase your Pass, y'all or your Domestic Partner are called to military service, your military leave is revoked, you are deployed or you are reassigned to a different duty station that is 100 or more miles further away from any resort covered by your Pass than your current assigned duty station.

j. Personal Illness.   Y'all are unable to employ your Pass during the Cadre Flavor because you suffer from a physical disease or physical illness that: (i) is diagnosed by a Physician after you buy your Pass or (2) presents meaning new or worsening symptoms that are diagnosed by a Physician after you buy your Laissez passer. To qualify, your illness or disease must prevent you lot from using your Laissez passer for thirty (thirty) or more than consecutive days, at to the lowest degree vii (7) days of which are during the Core Flavour. A "Physician" is a licensed doctor practicing in the fields of medical, surgical, dental, or psychiatric services who is interim within the scope of their license and who is non you lot, a traveling companion, a Family unit Member, a person related to you or a business partner. The term "Family Member" ways your child, Domestic Partner, brother, sister, mother, father, step-child, footstep-brother, pace-sis, pace-parents, legal guardian, foster child, ward or legal ward. m. Personal Injury. You are unable to utilize your Pass during the Core Season because you suffer an accidental bodily injury that occurs afterward yous purchase your Pass and that injury prevents you lot from using your Pass for thirty (xxx) or more sequent days, at least 7 (7) days of which are during the Core Season. This provision applies merely if yous provide verification from a Physician.

l. Family Member Disease or Injury. You lot are unable to use your Pass during the Core Flavor because a Family unit Fellow member who lives in the aforementioned Permanent Residence as you suffers from (i) a physical disease or physical illness that is diagnosed past a Physician afterwards you lot purchase your Pass; or (ii) a physical disease or physical disease that presents significant new or worsening symptoms that are diagnosed past a Physician after you purchase your Pass; or (3) an accidental actual injury afterward you purchase your Pass. To authorize, the disease, illness, or injury must require your continued intendance for that Family unit Fellow member for thirty (30) or more consecutive days, at to the lowest degree seven (7) days of which are during the Core Season. p. Subpoena/Jury Duty. You are unable to apply your Laissez passer during the Cadre Flavor because you are subpoenaed or required to serve on a jury and that subpoena or jury service prevents you from using your Pass for xxx (30) days, at least seven (7) days of which are during the Cadre Season.

q. Student Transfer. You are a higher student, enrolled in at least twelve (12) credits if you are an undergraduate or six (vi) credits if you are a graduate student, and y'all are unable to use your Pass during the Core Season because, subsequently you purchased your Laissez passer, you (a) transfer to a school located 100 miles or more than farther away from whatever resort covered by your Laissez passer than your current school, (b) are accepted into a foreign report programme that will cause you to be out of the country for 30 (30) or more consecutive days during the Core Season or (c) graduate and brainstorm piece of work at a job that is 100 or more miles farther away from any resort covered by your Pass than your current school. This provision only applies if your current school is located within 150 miles of a resort for which your Pass provides access.

r. Pregnancy.

i. Y'all are unable to use your Laissez passer during the Core Season because yous or your Domestic Partner learn yous are meaning after you purchase your Laissez passer.

ii. You are unable to use your Pass during the Core Flavour because you lot or your Domestic Partner are pregnant and a Physician (i) admits you or your Domestic Partner to the hospital for thirty (30) or more sequent days, at least 7 (7) days of which are during the Core Season or (ii) advises you or your Domestic Partner not to ski or ride.

s. Adoption. Yous are unable to use your Pass during the Cadre Flavour because you adopt a kid later on you purchase your Pass.

t. Pocket-size Dependent.  Yous are under the age of eighteen (18) and are unable to use your Pass because your parent or legal guardian has experienced a Qualifying Personal Event.

two. Refund Amounts. If you lot are eligible for a Personal Event Refund, the corporeality of your refund will be a percentage of your Purchase Price (the "Personal Issue Refund Percentage"). The utilize of your Flavor Pass at Partner Resorts or outside of the Core Season, including during early season skiing or riding with Border Cards (or other products with like offerings), will count towards the number of days y'all accept used your Laissez passer for purposes of determining the corporeality of whatever refund for which yous may be eligible. In no result will yous receive any Personal Event Refund if you lot have used your Pass on seven (seven) or more days. The corporeality of your 22/23 Credit Rollover will equal your Personal Event Refund Percentage multiplied past the amount of your Credit Rollover actually practical to your 2021/2022 Season Pass. You can only redeem your Credit Rollover towards the purchase of a single Season Laissez passer for the 2022/2023 season. You cannot redeem whatever portion of your 22/23 Credit Rollover for greenbacks. If the Flavour Pass you lot purchase for the 2022/2023 season costs less than your 22/23 Credit Rollover, the remaining portion of the 22/23 Credit Rollover will be forfeited. Your 22/23 Credit Rollover is non-transferrable. You must use your 22/23 Credit Rollover on or before September 5, 2022 or information technology volition expire and exist forfeited. Vail Resorts may, in its sole discretion, elect to convert whatever Credit Rollover or 22/23 Credit Rollover to a refund at any time.

4. How to Request for a Personal Upshot Refund.

a. Time Limitations. You lot must submit your request for a Personal Issue Refund within thirty (30) days of when the Qualifying Personal Event arises. Untimely submissions may exist rejected.

b. Grade of Request. c. Proof Requirements. Vail Resorts reserves the right to crave you to submit proof to verify and establish the Qualifying Personal Event that is the footing for which you request a refund. This proof may include Physician verifications, videos, photos, travel documents, or other cloth we deem necessary to evaluate your refund request. You have an obligation to cooperate with us in our efforts to verify your Qualifying Personal Effect, and we reserve the right to deny your refund request if you neglect to do and so. If yous are unable to provide adequate proof of a Qualifying Personal Issue (as determined in our sole and absolute discretion) we reserve the correct to deny your refund request.

five. No Access Subsequently Refund. If you receive any Personal Result Refund, the Laissez passer for which you received the refund will cease to exist valid and you will no longer exist able to use the Pass to access whatsoever resorts or receive any other ancillary Pass benefits for the remainder of the 2021/2022 season.

RESERVATION SYSTEM
